Lipstick & Ballistics Terms and Conditions

WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT (THE “AGREEMENT”) WITH Amie Lee Lipstick & Ballistics, Porthole LLC and GPC1 Amusements. I AGREE TO READ EACH OF THE FOLLOWING PARAGRAPHS CAREFULLY, AND I ACKNOWLEDGE THAT I HAVE THE OPPORTUNITY, IF I WISH, TO DISCUSS AND NEGOTIATE ANY OF THE TERMS CONTAINED IN THIS WAIVER AND RELEASE.

 

I am knowingly, willingly and voluntarily agreeing to my participation Class(-es) Amie Lee Lipstick & Ballistics, Porthole LLC and GPC1 Amusements. With including but not limited to training, related events and activities, and classroom time (the “Activities"), amidst the ongoing Coronavirus Pandemic (COVID-19). I acknowledge, understand and appreciate that there are risks involved with my participation in the Activities under these circumstances, including but not limited to becoming ill from COVID-19 or transmitting COVID-19 as an asymptomatic or symptomatic carrier. I understand that it is impossible to eliminate the risk that I could have contact with individuals who have been exposed to and/or have been diagnosed with one or more communicable diseases, including COVID-19 and further understand that it is impossible to eliminate the risk that I could be exposed to and/or become infected through contact with or close proximity with an individual with a communicable disease. I hereby acknowledge and agree that my participation is voluntary and that I knowingly and willingly assume the risks, both known and unknown, associated with participating in the Activities, including but not limited to the risks associated with any communicable disease, including COVID-19 and/or any mutation or variation thereof. In further consideration for being permitted to participate and continue participation in the Activities, I, for myself, my heirs, personal representatives or assigns, agree to release Amie Lee Lipstick & Ballistics, Porthole LLC and GPC1 Amusements, along with its instructors, officers, employees, staff, directors, agents, volunteers, coaches and insurers (“RELEASED PARTIES”) from and against any and all liability, claims, demands, actions, or causes of action of any kind or character, including but not limited to, personal injury, illness or death, which may result from my participation in the Activities. This release includes and waives claims based on the negligence of the RELEASED PARTIES to the fullest extent permitted by law, but this release does not include and does not waive claims based on the intentional or reckless conduct of the RELEASED PARTIES.

 

I knowingly, willingly and voluntarily agree to comply with all legally required conditions for participation as regards protection against infectious diseases and any and all processes or protocols implemented by Amie Lee Lipstick & Ballistics, Porthole LLC and GPC1 Amusements, including without limitation taking temperatures before club events and refraining from attending if symptomatic. If I observe any unusual or significant hazard during my presence or participation in the Activities, I will remove myself from participation and bring details of such hazard to the attention of Amie Lee Lipstick & Ballistics, Porthole LLC and GPC1 Amusements immediately.

This Agreement shall be governed exclusively by the internal laws of the State of Wisconsin, Michigan and Minnesota .

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT BY SIGNING THIS AGREEMENT I AM RELEASING CLAIMS AND GIVING UP SUBSTANTIAL RIGHTS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT..
